Terms of Service

By commissioning an artwork from myself @ thalo illustrations,
you are agreeing to the Terms of Service listed below:


1. The Artwork

The client (you) is commissioning the artist (myself) to create an original drawing using India ink on artist-grade paper. The completed artwork is to be of the agreed-upon ink colors, drawing size, and described subject matter.


2. Commission Timeline & Payment Schedule

  1. The client submits the Commission Request Form to start the process.

  2. The artist will respond to the client's request via email to discuss the details.

  3. When the artist and client agree upon the request and choose to move forward, the artist will send the client a quote that contains the amount to be paid to the artist and the estimated timeline for the shipped completion of the drawing (this will not include delivery date - shipping times are outside of the artist's control).

    • The quoted amount is valid for 1 month after being emailed to the client. If the quote expires before the client agrees to it, the artist has the right to provide a new quote at the client's request. The new quote's price may differ from the original quote.

  4. When the client accepts the quote, they will be added to the waiting list. The waiting list ensures that commissions are completed in order.

  5. The artist will notify the client when they have availability to begin working on the commission.

  6. The client will be emailed an invoice for the full quoted amount.

    • The client has 1 week to pay the invoice or make payment arrangements with the artist to keep their wait list position.

    • Payment is required in full for the artist to begin work.

  7. The artist will begin working on the preliminary/draft sketch (pencil on sketch paper).

  8. The artist will email a photo of the preliminary sketch to the client.

    • The client can make up to 3 minor changes to the drawing.

    • If the client requires significant changes (such as completely different poses, composition, additional characters, etc), additional charges may occur at the artist's discretion to revise the original quote. If additional charges occur, the client will be sent a revised quote and must pay the additional amount before the artist creates another preliminary sketch.

  9. The client will approve the preliminary sketch.

  10. The artist will begin the final drawing.

  11. When the drawing is complete, the artist will send a photo to the client before shipping.

  12. The artist will ship the drawing!

3. Artist Rights & Right of Refusal

  • The artist has the right to refuse/decline any commission requests for any reason at any part of the process.

  • The artist has the right to use images of the commission for self promotion, such as including the image in their online and physical portfolios, uploading images of the artwork to their social media, and streaming in-progress videos of the artwork.

  • The artist will not sell reproductions of the commissioned artwork.

  • If the artist is unable to meet the agreed-upon completion deadline at any point in the process due to illness, injury, or other cause, the artist will refund 100% of the commission price back to the client. The artist will have no further liability with respect to this agreement.


4. Client Right of Artwork Ownership

  • The client cannot claim the artwork as being created by themselves or by another entity other than the artist.

  • Commissioned artwork is for personal use unless commercial use is explicitly agreed upon by the artist and client.

  • Personal use includes:

    • The client not using the artwork to gain money; including, but not limited to: selling reproductions, selling products depicting the image, or using the image in business logos and media.

    • The client can post images of the commission on social media platforms - please give credit to thalo illustrations, when possible!

5. Client Right of Refusal (Cancellation)

  • In the event that the client chooses to cancel the commission, the artist will retain the refused artwork. The artist may choose to complete the artwork at their discretion and creative liberty (may use concepts and poses, but with different characters).

  • Refunds: The client can request refunds during the parts of the process, which will cancel their request:

    • Prior to completing payment of the invoice, the client may cancel their request with no penalty.

    • 100% refund within 48 hours of paying the invoice.

    • 75% refund for cancellation after the artist emails the client the preliminary sketch.

    • No refund after the preliminary sketch is approved by the client.

6. Artwork Delivery & Delay Policy

    • The commissioned artwork is a physical drawing that will be mailed to the agreed upon shipping address. The artwork is to be postmarked by the agreed upon deadline date as defined in the invoice.

    • The artist is not responsible for delivery date, as they have no control of it after it's been shipped.

    • If the artist becomes unable to meet the agreed upon deadline date, the artist will discuss options with the client to agree upon a new deadline date or cancel the commission.
